What is a Mechanic’s Lien?

Mechanic’s liens are meant to protect builders and contractors from nonpayment for services. They were developed in recognition of the fact that people who provide services are uniquely vulnerable to this problem. When a company does not receive fair payment for a good, they have the option of taking it back. Construction companies cannot simply demolish structures for which they have not been paid.

A successful mechanic’s lien compensates contractors for non-payment by giving them partial ownership of a piece of property they have worked on. They may receive part of the value of the building or the land on which it is built. Depending on the contract involved, a business owner may not fully own his or her property until the construction teams have been fully repaid.
